Despite the recent win for Washington state against an out of state liquor maker seeking direct to consumer privileges, a new lawsuit has been filed in New York on behalf of a California distillery.
The lawsuit claims that New York laws that permit shipping to consumers by New York distilleries in certain circumstances violates the dormant Commerce Clause because out of state distillers do not have the same ability. The lawsuit also seeks to challenge the use of reciprocity laws which both New York and California retain in their state beverage codes and the plaintiff invokes the dark period around the Articles of Confederation as the reasons why they need to have these laws struck to save the republic.
