Lawsuit Filed in Florida Over Growlers

A federal lawsuit was filed over the much publicized 64 ounce growler issue. The lawsuit was filed by a retailer, not a small brewer. They are represented by the Pacific Legal Foundation. The lawsuit can found on their website.

The lawsuit claims a violation of the equal protection and due process provisions of the 14th Amendment. In part the complaint notes that a majority of states allow for the 64 ounce package size and implies this makes Florida’s law vulnerable. Recent challenges to state laws by pointing out other state laws have failed in the 6th Circuit and in Indiana.

Moreover, this issue was expected to be resolved legislatively when the session resumed in January with a wide variety of interests supporting a clean 64 ounce growler bill. It is unknown at this point if this lawsuit will complicate a legislative fix.
