Still Waiting for Decision on New York Winery Distribution Challenge

One lawsuit that has already been briefed and had a bench trial is Alba Vineyards v. New York. This lawsuit argues that New York laws banning a New Jersey winery from self distributing to New York retailers are violations of the dormant Commerce Clause.

I neglected to fully brief this case but since the trial was held in August of 2024, a decision is likely to come soon. In the meantime the parties argue over post trial motions related to the meaning of court decisions on other alcohol retail shipping cases to this winery shipping case. Here is the most recent letter from the New York Attorneys General office.
